Terms & Conditions
CHECK IN AND CHECK OUT: The rental period begins at 4:00 p.m. on the day of arrival and terminates at 10:00 a.m. on the day of departure. Parking in the accommodation driveways and/or unloading of personal items prior to 4:00 PM is not permitted. Our teams need unrestricted access to the property in order to preparing for your 4:00 PM check-in time. Check-out time is 10:00AM (CST). No early check-in or late check-outs will be permitted. Attempted early check-in prior to 4:00 PM or guests not checked out promptly at 10:00 AM will be billed a full day’s rate. In the event that this situation occurs, any housekeeping or maintenance issues that are reported upon arrival will not be addressed until the following day. Our properties are professionally cleaned and inspected before and after each rental to ensure that all guests have a clean comfortable stay. Additionally, maintenance items are also completed during the vacancy period. Please be thoughtful of renters who may be checking in on the same day that you checkout.
DEPOSIT AND PAYMENTS: In order to secure your stay, 50% of your reservation is due within 24 hours of your reservation. The total is due 30 days prior to your check in date. If you have a credit card on file it will be charged automatically unless other payment arrangements are made. Please review your reservation and make sure all the information including check in and check out dates are correct.
PAYMENT TERMS: Credit Cards, Electronic Funds or Electronic Checks are accepted. There is a $50 charge for all returned checks plus the cost of collection.
CREDIT CARD AUTHORIZATION: I understand and consent to the use of the credit card provided without original signature on the charge slip, that an email of this agreement will serve as an original, and that this Credit Card Authorization cannot be revoked and will not terminate until 90 days after the rental is vacated. Additional charges may include: excessive cleaning fees; damages beyond normal wear and tear and unreturned keys. All charges not covered under the Damage Protection Insurance may be included. CHARGEBACKS: Card holder agrees to pay a fee of $1500, all collection fees, attorney fees and $20 per day until the debt is collected for wrongful credit card/bank disputes and chargebacks.
DAMAGE PROTECTION: It is required by ACE Properties of FL that in lieu of a security deposit, Guest must purchase Vacation Damage Protection. An inspection of the property will be conducted following your departure. Should an inspector find that the unit is inordinately dirty, items are missing from the property, or there is obvious damage to the property and/or its contents, Guest will be notified and advised of the claim process. Damage Insurance does not cover soiled linens/towels, missing linens/towels, missing items or extra cleaning. ACE Properties of FL reserves the right to charge Guest for damages exceeding $3,000. A credit card will be held on file for any such damages as Guest is personally and financially responsible for such damages.
TRAVEL INSURANCE: Travel insurance is highly encouraged, and will reimburse you in the event that unforeseen events disrupt or cause delay or cancellation of your trip. A complete review of this policy is available at www.rentalguardian.com. A representative can be reached at 888.885.5550. No refunds will be issued within 90 days prior to check-in without this coverage. Please review the CANCELLATION POLICY stated in this contract.
RATES: Terms and applicable taxes are subject to change without notice. We reserve the right to move Guest up to 30 days in advance to a comparable property or refund the Guest the amount paid.
LOST AND FOUND:
Items left behind by our guests will be returned to the warehouse once the unit has been cleaned. Items of value will be brought to our facility and labeled. Should you wish rerun of your forgotten items, please notify info@aceproperteisfl.com, and they will be returned to you within 5-7 business days. The charge for rerun will include Priority Mail shipping fees and a $25 service fee.
OCCUPANCY RESTRICTIONS: Guest is responsible for insuring that the number of occupants at no time exceeds the advertised maximum sleeping capacity of the property as stated in the property description. Furthermore, no one under the age of twenty-five (25) may rent or occupy the property as Guest or without adult supervision a ratio of four (4) young adults to one (1) adult over the age of 25. A parent or guardian must be staying in the property at all times.Violation is cause for eviction without refund of any kind, and will result in liability for any and all damages that have resulted due to this infraction.
CANCELLATION POLICY:
a.) Cancellation of the reservation is acceptable if notice of cancellation is given within seven (7) days of making the reservation. A full refund will be made LESS PROCESSING FEES. Following the seven (7) day grace period, if a cancellation occurs and/or the final payment has been submitted, all funds collected will be FORFEITED. Loss can be avoided through the purchase of TRAVEL INSURANCE. We strongly recommend the purchase of travel insurance, which can be done through ACE Properties of FL.
b.) Hurricane or Storm Policy. In the event that the National Weather Service issues a Tropical Storm or Hurricane warning, and/or a mandatory evacuation, a full or partial refund will be issued to the holders of Travel Insurance only. This policy is obtainable through ACE Properties of FL at the time of booking, and cannot be purchased in the wake of a pending storm. We strongly encourage our guests to obtain such a policy, as we are not responsible for any such act of nature.
DAMAGE AND CLEANING ISSUES: Any damage or cleaning issues noticed upon arrival should be reported to ACE Properties of FL immediately. If damage or cleaning issues are not reported within 3 hours of your arrival, your credit card may be charged for the cost of the repair. All general maintenance issues should also be reported so the unit can be kept in good repair. You must contact ACE Properties of FL to address any cleaning issues within 3 hours of your arrival. You will not incur any additional charges if the following items are adhered to:
No damage is done to the unit or its content including the linens.
No items are missing upon the inventory check. (This includes, but is not limited to, transferring items to other units.)
All debris, garbage and discards are placed in proper containers.
All soiled dishes are placed in the dishwasher.
There was no smoking or evidence of smoking in a designated non-smoking unit.
Unit is left in neat condition.
Pet friendly units show no sign of pet damage or excessive cleaning
If you experience any problems whatsoever with the vacation property during your stay, please contact us and we will do our best to rectify the matter as soon as it is practically possible. Should a problem remain unresolved, you are required to notify us in writing within 7 days of your return.
NO SMOKING: Smoking is not allowed inside any of our units. Smoking is not allowed outside in garages, balconies or driveways. Smoking within the property, or not properly securing the unit while smoking outside, and causing the property to smell of smoke, or not properly disposing of cigarette butts and ashes will result in a $1,000 fine. NO EXCEPTIONS.
COMMUNITY RULES: Guest agrees to abide by rules of the community. These may be posted in the unit or at the community pool or office. These rules may change from time to time.
PET POLICIES: Pets are permitted only in units specified as “Pets Allowed” properties. This policy refers only to dogs, and no more than two are permitted during the accommodation period. A non-refundable Pet Fee ($100 per pet) is required to permit pets on-site, and failure to secure permission through payment of the Pet Fee will result subsequent actions by ACE Properties of FL to include a minimum fine of $500 plus any additional cleaning fees, and not to exclude eviction. Guest pets must be treated for fleas and ticks prior to arrival. Guests must pick up after pets and tightly tie the remnants in a plastic bag if staying in a Pet Friendly Unit. Pets are not allowed on the furniture and all pet hair must be cleaned up prior to departure. A $150 fee will be charged if there is any report of pet hair on bedding and sofas. Guest pets must be leashed at all times when outside of the unit and under no circumstances are Guest pets allowed on the beach. The violation of any terms of this pet policy subjects the guest to additional fines or termination of the rental period. Guest pet policies and unit availability are subject to change per county and association rules and regulations at any time.
FALSIFIED RESERVATIONS: Any reservation obtained under false pretense or in violation to the terms and conditions of this agreement will be subject to forfeiture of advance deposit and/or rental money and the party will not be permitted to check-in.
GOLF CARTS AND BIKES: Golf carts and bicycles that are offered as part of the rental property at no extra charge are considered ancillary products. These items are serviced and maintained on a regular basis and should be in working condition upon arrival. In the unforeseen event that one of these items needs repair during your stay, every effort will be made to repair the item in a timely manner; however, no refund of any kind will be issued as a result of loss of use. Any violations to the stated policies will result in fines and fees to the cards on file greater than or equal to the total rental amount to be determined by ACE Properties of FL.
LOST, STOLEN AND MISPLACED ITEMS: Neither ACE Properties of FL nor the Property Owner assumes liability for items that may be lost, stolen misplaced or damaged during the duration of the rental period. In the event that personal items are left behind after departure, please contact our office to arrange return shipping. Items will be returned at the expense of the guest.
PARKING: Parking restrictions must be observed at all times and parking is permitted in designated areas only.
QUIET ENJOYMENT: Local county ordinances prohibit unreasonable disturbance of others. Decibel levels are not to exceed fifty (50) decibels at any time between the hours of 10:00 P.M. and 7:00 A.M. Violation and breach of the peace includes music heard on the outside of the property with windows and doors secured. Unregistered guests of the property are required to depart no later than 11:30 P.M.
LOCKOUT AREAS: Properties with areas such as garages and closets that are designated off-limits to guests must not be accessed or attempted to be accessed during occupancy. Violation especially by forced entry will be reported to local authorities as breaking and entering. Please regard any an all locked spaces as those for owner use only.
CONDITIONS OF PREMISES: Upon departure the premises must be left in the order in which it was entered. This includes removal of perishable items, and placement of garbage in designated areas. All dirty dishes, glassware and flatware should me placed in dishwasher and the cycle started. Windows and doors should be secured, and thermostats should be adjusted according to the season. 78º in warmer months and 67º in the cooler times of the year.
INDEMNIFICATION: In the event of any accident or incident that causes damage, bodily injury or casualty to the Guest or any member of the occupying party, by signature of this agreement all occupying parties agree collectively to hold harmless and waive the right to hold negligent the Property Owner and/or ACE Properties of FL and any and all representatives thereof. This is to include any and all recreational items such as golf carts, scooters and bicycles.
INTERFERENCE WITH STAY: ACE Properties of FL will make every effort to stay informed of pending construction, closure of facilities related to the property, upcoming events such as concerts that can cause disturbance, etc. However, ACE Properties of FL shall not be held responsible for such occurrences that are beyond our control.
RIGHT OF ENTRY: ACE Properties of FL may enter upon the leased premises at ay time for the protection and preservation of the premises, in the event of an emergency, or known or suspected violation of policies set forth by this agreement. When entry is necessary for repairs or services agreed upon by both parties, ACE Properties of FL will make every effort to provide ample notice of three (3) or more hours. Inability to extend such notice for reasons set forth above shall not however prohibit entry. Guest agrees to allow for Realtor accompanied showings (with a minimum 24 hour notice) if the rental property is on the active market.
GOVERNING LAW: This agreement shall be governed by the laws of the state of Florida. Each of the parties irrevocably consents to the exclusive personal jurisdiction and governing laws of the federal and state courts located in the state of Florida and within Walton County as applicable, for any matter arising out of or relating to this Agreement.
ENTIRE AGREEMENT: I agree that this is a legally binding document and I have read all terms and conditions in this document. This Agreement constitutes the entire agreement of the parties and supersedes all prior or contemporaneous oral or written agreements concerning this subject matter. ACE Properties of FL reserves the right to make modifications or changes to this contract at any time. Such changes must be relayed via email or text to the assigned guest with a minimum of 24 hour notice. Any violations to the stated policies will result in fines and fees to the cards on file greater than or equal to the total rental amount to be determined by ACE Properties of FL.
Additional things to consider for Spring Break Rentals
Reservations made for teenagers or young single groups will not be honored without an accompanying adult couple staying in the unit at ALL times. Guest is responsible for insuring that the number of occupants at no time exceeds the advertised maximum sleeping capacity of the property as stated in the property description. Furthermore, no one under the age of twenty-five (25) may rent or occupy the property as Guest or without adult supervision. The majority of occupants must be over the age of 25. Violation is cause for eviction without refund of any kind, and will result in liability for any and all damages that have resulted due to this infraction.
Any violators will be evicted according to the attached contract with forfeiture of all monies. No rental property may be sublet without written permission from ACE Properties of FL. Your reservation is not transferable to another party without written or emailed permission & acknowledged in writing from ACE Properties of FL and all parties may be asked to present valid Identification.
Parents, and/or adults over the age of 25, are not allowed to check-in and then leave the property to under-aged guest(s); they must stay at the property throughout the duration of the reserved stay dates.
Any group whose behavior creates a disruption or interferes with their neighbor’s reasonable peaceful enjoyment of their property will be subject to eviction and no refund of any kind will be made. Reservations made during Spring Break must be paid in full at least 7 days prior to the check in date. ACE Properties of FL reserves the right to inspect any property with or without notice to the guest.
